Nothing sends a business school community deep into depression like seeing its MBA program fall out of the top 10 in a major ranking. Well, yesterday, Businessweek released its biannual rankings, and the losers were UC Berkeley Haas and Columbia Business School, which fell from 8 to 13 and 9 to 14 respectively. Meanwhile, the winners were Darden, which jumps from 11 to 10, and Cornell, which made an enormous leap from 13 to 7. Meanwhile, Dartmouth Tuck (12), NYU Stern (16) and Yale SOM (21) all have to shake their heads. These excellent schools will spend two more years on the outside looking in.

All of that said being said, let?s take a step back and think about rankings a little more carefully. What do rankings do, other than simplify your perspective on a?very complex entity? If you are interested in retail marketing, should you shun NYU, which has an excellent program, because it is ranked 16th?overall? If you want to be part of a small and tight-knit community, do you write off Tuck at 12 or Haas at 13? If you just do not see yourself performing well in a case method environment, should you apply to HBS because it is number 2?

Business schools are not numbers ? they are complex communities, each with their own personalities, strengths and weaknesses. You are not choosing a ranking, but an education and an experience. In short, determine what you want in a school and evaluate each on its own merits. After all, your two years will stay with you throughout your life, but rankings will come and go.

Webster Schools only NYS district named to College Board's AP Honor Roll for three consecutive years

The Webster Central School District announced that it is the only New York State district named to the College Board?s 3rd Annual AP? District Honor Roll for three consecutive years. Webster was one of a record 539 districts across 44 states and Canada honored with placement on the 2012 AP District Honor Roll, and one of 40 districts overall named every year since the honor roll?s inception.

School districts achieve honor roll status for simultaneously increasing access to Advanced Placement? course work while maintaining or increasing the percentage of students earning scores of 3 or higher on AP Exams. A majority of U.S. colleges and universities offer college credit, advanced placement, or both for a score of 3 or above on AP Exams.

Webster students have continued to make substantial progress in opening up college-level, AP learning experiences for high school students. Since the 2008-2009 school year, Webster Central School District has increased the number of students enrolled in at least one AP class by 37 % (415 students). On the 2012 AP exams, 77% of Webster students scored a 3 or higher -- outpacing the state average of 66%, and the national average of 59%.

Breakdown of the $4.5 Billion BP Criminal & Securities Settlements ...

As Richard noted in an earlier post, today, British oil company and deep water drilling giant, BP, announced that it had reached settlements of all federal criminal and securities claims related to the 2010 Deepwater Horizon oil spill in the Gulf of Mexico with the Securities and Exchange Commission (SEC) and the U.S. Department of Justice (DOJ).? The criminal plea agreement and securities violation resolution remain subject to federal court approval before they are final.

Settlement Breakdown:

  • BP pleads guilty to 14 criminal charges, including:
    • 11 felony counts of manslaughter under maritime law? (18 U.S.C. ? 1115, ?Misconduct or Neglect of Ships Officers?);
    • 1 misdemeanor count under the Clean Water Act;
    • 1 misdemeanor count of unlawfully ?taking, killing, or possessing migratory birds? under the Migratory Bird Treaty Act (16 U.S.C. ? 703); and
    • 1 felony count of obstruction of Congress (based on two communications to a member of Congress underestimating the amount of oil leaking from the Macondo well during the spill).
  • BP and the SEC resolved securities claims under sections 10(b) and 13(a) of the Securities Exchange Act of 1934 and its regulations (related to oil flow rate estimates BP provided in three SEC reports shortly after the well explosion in April and May of 2010).
  • Payments include the following: $1.25 billion in criminal fines; $2.4 billion to the National Fish and Wildlife Foundation, $350 million to the National Academy of Science, and $535 million to the SEC. Payments will be dispersed over a period of three to five years.
  • BP will be under probation for five years.
  • BP will be subject to an injunction prohibiting it from violating securities laws and regulations.? If BP violates the injunction, the SEC could petition the Court to hold BP in contempt.
  • Two monitors will be appointed for four-year terms to monitor process safety and risk management, and ethics implementation and enforcement.
  • BP has agreed to take additional, court-enforceable actions to enhance drilling safety in the Gulf of Mexico, including: third-party auditing, training, well-control processes (e.g., blow-out preventers and cementing), working with academia and regulators to develop new drilling safety technology.
  • At this time, BP has not been debarred from contracting with the federal government, although federal law provides that companies convicted of certain criminal acts can be disqualified from federal government contracting.? (This is not so surprising considering that BP reports it has invested over $52 billion in United States drilling over the past five years and employs 23,000 Americans).
  • An exhibit to the plea agreement will contain an ?allocution? that will list all of the facts to which BP admits.

So BP finally admits it was guilty?is the legal saga now over?

Unfortunately, no.? First, BP?s guilt admission is not such extraordinary news.? BP?s 2010 report on its internal investigation of the Deepwater Horizon disaster essentially acknowledged that a negative pressure test conducted aboard the Deepwater Horizon was negligently misinterpreted: ?The Transocean rig crew and BP will site leaders reached the incorrect view that the test was successful and that well integrity had been established? (p. 10).? The allocution nonetheless could provide some interesting factual admissions.

Second, the federal civil claims have not yet been resolved.? Federal civil penalties under the Clean Water Act could be much larger, in the $10 billion to $20 billion range. Notably, Carl-Henric Svanberg, BP?s Chairman, made a statement that this criminal settlement allows BP?s officers and legal team to ?vigorously defend the company against the remaining civil claims.?

In addition to the federal civil claims, there are remaining state and federal Natural Resource Damages (NRD) claims under the Oil Pollution Act, pending private civil claims not covered by BP?s settlement with the Plaintiff?s Steering Committee (PSC) in multidistrict litigation (MDL) No. 2179, as well as private securities claims in MDL No. 2185, among other claims.

Prior to this settlement announcement, DOJ was rumored to be pursuing a ?global settlement? of all claims, including both criminal and civil claims.? Apparently, the parties could not reach a global settlement.

Will $4.5 billion be enough money to recover the Gulf from the damages of the oil spill?

Criminal penalties are intended to punish wrongdoers?not restore ecosystems.? The natural resource damages paid by BP under the Oil Pollution Act will be used to restore the Gulf.? In addition, with the recently-passed RESTORE Act (which I mentioned in an earlier post), a portion of any civil penalties recovered by the federal government under the Clean Water Act will be diverted broadly to environmental and economic restoration projects in the Gulf Coast region.

Still, this is the largest criminal plea agreement that DOJ has ever secured?the next-largest criminal penalty was a $1.2 billion fine imposed on pharmaceutical company Pfizer in 2009.? (Note that E&E News reports that the DOJ inspector general?s office has spent more than $7 million over the past several years on the government?s criminal case against BP.)

To date, BP has spent over $14 billion on clean-up, committed $1 billion to early natural resource damage restoration projects, paid $9 billion to private claimants for economic, property, and medical damages, and? committed in its recent settlement with the PSC to paying an estimated $7.8 billion in additional payments to private claimants.

How can a corporation plead guilty to crimes?

Although the U.S. Supreme Court famously declared in Citizens United that corporations are ?people,? that case is not the basis for BP?s criminal liability here.? Under federal law, corporations may be held liable for the crimes of their officers and employees.? Instead of serving jail time or suffering the death penalty, corporate entities pay criminal fines. (Some states also recognize corporate criminal liability. See generally, Model Penal Code ? 2.07 ?Liability of Corporations, Unincorporated Associations and Persons Acting, or Under a Duty to Act, in Their Behalf?).

Importantly, DOJ continues to prosecute individuals for crimes related to Deepwater Horizon.? Indeed, federal indictments released shortly after the settlement was announced today charge two BP well site leaders with manslaughter, and BP?s Vice President of Exploration for the Gulf of Mexico, David Rainey, has been charged with obstruction of Congress and false statements.? Previously, a former BP engineer had been charged with obstruction of justice.

Two Tibetans dead after self-immolation protests in China

The Voice of America (VOA) quoting Tibetan sources said that two Tibetans have died after setting themselves on fire in Qinghai.

Citing sources in the region, the radio service said that the latest to fell victim to deadly protests were 18-year-old Kabum Gyal and 23-year-old woman Dangzin Dolma.

The man and woman set themselves afire in two separate incidents in different areas of Tongren county, known in Tibetan as Rebkong.

The VOA said 74 self-immolation protests were reported in Tibetan regions of China since 2009, with 60 cases known to have resulted in deaths.

The Washington-based Radio Free Asia also reported the latest incidents, which were also confirmed by the London-based Free Tibet.

The group said that the protests were meant to highlight Tibetan unhappiness with Chinese rule as the country's leaders handed over power to Xi Jinping and six other members of the Politburo Standing Committee.

Tibetans accuse the Chinese government of suppressing their religious and cultural rights.

China says Tibetans enjoy religious freedom and benefit from better living standards linked to Chinese investment in underdeveloped Tibetan regions.

Chinese leaders have blamed exiled Tibetan spiritual leader the Dalai Lama for inciting the self-immolations to promote Tibetan separatism.

Prime Minister Lobsang Sangay, who lives in exile with the Dalai Lama in this hill town of India, Friday told a meeting that "the international community will clearly show what they stand for" in supporting Tibetan cause.

"Tibet is a litmus test for China and the world," Sangay said.

He was speaking at a special meeting in Dharamsala, the headquarters of the Dalai Lama.

About 200 delegates are participating in the three-day meeting of Tibetan support groups to seek international help to make China change its "repressive policies".

"By not supporting us in our non-violent struggle, the world will send a wrong message to all oppressed people of the world," Sangay said, stressing that his people remained committed to a non-violent approach in resolving their 60-year long struggle.

He said it was time for the international community to recognize this and focus on Tibet.

During a visit to Japan on Monday, the Dalai Lama said China must conduct a "thorough investigation" into the self-immolations rather than placing the blame on him.

First off, this wasn't on my DT but on my former 20 gallon QT, now frag tank.

A couple of weeks ago, my LTA decided to spill his guts (including a now mostly digested shrimp). Not good in a 20 gallon tank as I don't think I saw it for a day or 2. That covered my most of my frags with a nice goo killing most of them except maybe one LPS. Not ideal but my LTA seems to be getting better and is back eating.

Then the temps drop. The problem is that this tank is in the basement where the heat isn't working right now (another long story..LOL). But I add a second small heater and the temps hold. I go to do a water change last weekend forgetting to turn off the second heater. After I'm done, I can feel electricity in the water. Clean out sponge filter and nice zap. I then remember the heater I added was part of the recall a couple of years back. Pull it out and no more zapping. Replace it, put in my titanium grounding probe to drain out the electricity.

Yesterday, my inverts are not looking good. My snails aren't moving. No response from my LTA and it's lost most of it's size. Today, they're all dead. ggrrrr. Pull them all out. Start to work on doing a water change and prepping carbon. Weird thing is that I can still feel a slight tingle when I have my hand in the water. No zapping but just enough that it doesn't feel right.

And then, before I've pulled any water out, I see the heater that's been in there for the last few years off of sudden burst and start boiling the water around it. I kill the power to the tank but it's now fouled beyond belief and the air in the basement stinks.

I just finished doing a 50% water change and hooked up my 2 fishies media reactor with a good amount of carbon to clean out the water.

In less than a week, both heaters went out on me. I was just lucky that I was there to see the second one burst. I have no idea the damage it could have done to the tank I hadn't seen it with my own eyes.

Sorry for the long rant....

(AP) ? Americans get too many calories from soda. But what about alcohol? It turns out adults get almost as many empty calories from booze as from soft drinks, a government study found.

Soda and other sweetened drinks ? the focus of obesity-fighting public health campaigns ? are the source of about 6 percent of the calories adults consume, on average. Alcoholic beverages account for about 5 percent, the new study found.

"We've been focusing on sugar-sweetened beverages. This is something new," said Cynthia Ogden, one of the study's authors. She's an epidemiologist with the Centers for Disease Control and Prevention which released its findings Thursday.

The government researchers say the findings deserve attention because, like soda, alcohol contains few nutrients but plenty of calories.

But a liquor trade association said the findings indicate there's no big problem.

"This research shows that the overwhelming majority of adults drink moderately," Lisa Hawkins, a spokeswoman for the Distilled Spirits Council, said in a statement.

The CDC study is based on interviews with more than 11,000 U.S. adults from 2007 through 2010. Participants were asked extensive questions about what they ate and drank over the previous 24 hours.

The study found:

?On any given day, about one-third of men and one-fifth of women consumed calories from beer, wine or liquor.

?Averaged out to all adults, the average guy drinks 150 calories from alcohol each day, or the equivalent of a can of Budweiser.

?The average woman drinks about 50 calories, or roughly half a glass of wine.

?Men drink mostly beer. For women, there was no clear favorite among alcoholic beverages.

?There was no racial or ethnic difference in average calories consumed from alcoholic beverages. But there was an age difference, with younger adults putting more of it away.

For reference, a 12-ounce can of regular Coca-Cola has 140 calories, slightly less than a same-sized can of regular Bud. A 5-ounce glass of wine is around 100 calories.

In September, New York City approved an unprecedented measure cracking down on giant sodas, those bigger than 16 ounces, or half a liter. It will take effect in March and bans sales of drinks that large at restaurants, cafeterias and concession stands.

Should New York officials now start cracking down on tall-boy beers and monster margaritas?

There are no plans for that, city health department officials said, adding in a statement that while studies show that sugary drinks are "a key driver of the obesity epidemic," alcohol is not.

Health officials should think about enacting policies to limit alcoholic intake, but New York's focus on sodas is appropriate, said Margo Wootan, director of nutrition policy for the Center for Science in the Public Interest, a public health advocacy group.

Soda and sweetened beverages are the bigger problem, especially when it comes to kids ? the No. 1 source of calories in the U.S. diet, she said.

"In New York City, it was smart to start with sugary drinks. Let's see how it goes and then think about next steps," she said.

However, she lamented that the Obama administration is planning to exempt alcoholic beverages from proposed federal regulations requiring calorie labeling on restaurant menus.

It could set up a confusing scenario in which, say, a raspberry iced tea may have a calorie count listed, while an alcohol-laden Long Island Iced Tea ? with more than four times as many calories ? doesn't. "It could give people the wrong idea," she said.
