ACLU: Russell Pearce Emails Show Arizona Immigration Law Was ...

PHOENIX -- Opponents of Arizona's hardline immigration enforcement law contend that emails sent, received and forwarded by a former legislator who championed the law support allegations it was racially motivated.

Dozens of emails are cited in a new legal effort by the American Civil Liberties Union and other civil rights groups to block police from enforcing the Arizona law's so-called "show me your papers" provision recently upheld by the U.S. Supreme Court.

The groups said the emails and other material reveal that ex-Sen. Russell Pearce and other supporters of the law known as SB1070 embraced discriminatory views and bent the truth about immigration-related matters, setting the stage for enactment of a law that the groups contend will lead to racial profiling if enforced.

Russell is the architect of Arizona's immigration law.

The use of the emails in the court filing later Tuesday was reported Friday by The Arizona Republic.

Pearce on Friday denied discriminatory intent in championing the law, telling The Associated Press that the civil rights groups falsely portray him as a racist and that the law includes protections against racial profiling.

"Nobody wants to talk about that," he said. "I've been attacked for years. I don't expect it to stop."

The motion cited dozens of emails that were sent, received or forwarded by Pearce. Many of the emails asserted costs and troubles associated with unauthorized immigration, including crime and increased demand for public services such as education and health care.

Pearce has made countless public statements to that effect in recent years, while repeatedly saying he just wants federal and state officials to enforce laws against unauthorized immigration.

In one article forwarded by Pearce from one of his email accounts to another in 2006, a commentator spoke of the United States "facing an overwhelming illegal alien invasion" in which Hispanic undocumented immigrants were "arrogantly corrupting our unifying national language while actively disrespecting our culture, society and country."

A 2007 email sent from Pearce's legislative email account to a personal Pearce account said unauthorized immigration of Spanish-speakers puts the country's status as an English-speaking country at risk.

"It's like importing leper colonies and hope we don't catch leprosy," the email stated. "It's like importing thousands of Islamic jihadists and hope they adapt to the American dream."

The five-page email contained multiple references to conditions in Arizona, but Pearce said the leprosy reference was from material written by a man in Colorado.

"I forward a lot of his stuff. Much of it is right on," Pearce said.

The Arizona law's so-called "papers" provision requires police to check the immigration status of people they stop for other reasons if there is reasonable suspicion the people are in the country without documentation.

The high court on June 25 rejected the Obama administration's argument that the provision was unconstitutional because federal law trumps state law. But the civil rights group now argues that it should be blocked because Latinos in Arizona would face systematic racial profiling and unreasonably long detentions.

The civil rights groups' motion argues that discriminatory intent by legislative supporters of the law would help prove that it violates the Constitution's right to equal protection under the law.

Jack Chin, a University of California-Davis law school professor, said courts typically are more interested in details of laws or their enforcement, and that legislative emails and questionable claims of fact have limited value as evidence.

"If we're talking about the bad views of one legislator, even an important legislator, that's going to be a hard sell because the majority of legislators who voted for the thing might not have been racially motivated," Chin said.

A spokesman for Gov. Jan Brewer said the groups' arguments are a smoke screen that won't succeed in court.

"By focusing upon an individual legislator's emails, they intend to divert focus from SB1070's simple, common-sense language - language that the overwhelming majority of Arizonans and Americans support, and language that the Supreme Court unanimously upheld," said Brewer spokesman Matthew Benson.

Pearce was Arizona Senate president when he was ousted from the Legislature after losing a November 2011 recall election. He is running for re-election to the state Senate.

Income from the Entertainment and Devices division, which makes up a much smaller chunk of revenue over all at just $1.78 billion, also grew dramatically year-over-year, largely because of the inclusion of Skype.

Alongside Q4's results, Microsoft also released its year-end financials and, while that $6.2 billion lump drove profits down, revenues were up by $3.76 billion from 2011. VANCOUVER, BRITISH COLUMBIA?(Marketwire ? July 19, 2012) - Channel Resources Ltd. (?Channel? or the ?Company?) (TSX VENTURE:CHU) is pleased to announce a maiden Mineral Resource Estimate for the Mankarga 5 deposit at its Tanlouka gold project (the ?Tanlouka Project?), located in Burkina Faso, West Africa.

The Company engaged AMEC Americas Ltd. (?AMEC?) to conduct a mineral resource estimate in accordance with National Instrument 43-101 standards (the ?Mineral Resource Estimate?) on the Mankarga 5 deposit based on 71 core drill holes and 58 reverse circulation (?RC?) drill holes for a total of 22,536 metres drilled since June of 2010.

AMEC?s Mineral Resource Estimate is derived from the application of a Whittle pit shell on the deposit?s total mineral inventory, estimated using a number of assumptions including a gold price of US$1,465 per ounce, preliminary metallurgical test results for the deposit, and estimates derived from comparable projects for mining, processing and general and administrative costs. The resulting Mineral Resource Estimate includes ?base case? Indicated and Inferred resources for both oxide and sulphide mineralization at discrete cut-off grades for each mineralization type as tabulated below:

As envisaged, the total resource is contained within one open pit with a strip ratio of 2.1:1. Two main structures and seventeen parallel hanging- and foot-wall structures have been identified within a broad shear zone. Gold mineralization is associated with silica alteration within metavolcanic and metasedimentary host rocks. The deposit extends over a strike length of approximately 2 kilometres trending northeast-southwest and remains open along-strike as well as to-depth. The project is situated approximately 100 kilometres east of Ouagadougou, the capital of Burkina Faso, and is proximal to a major highway, with good local infrastructure and in an area of low population density.

Mineral Resource Estimate Assumptions and Parameters

  • Inverse distance squared interpolation methods were employed with statistically derived top cuts applied to three-metre composited grades.
  • The Mineral Resource Estimate is based on core and RC drill hole assays available as at July 4, 2012, which represents the effective date of the Mineral Resource Estimate.
  • Mineralized zone outlines were interpolated from drill hole intersections using a minimum sample grade of 0.20 g/t gold.
  • Gold grades have been determined using Inverse Distance Squared interpolation techniques into a 3-Dimensional block model constrained by mineralization wireframes utilizing 20 metre (along strike) by 20 metre (across strike) by 5 metre (vertical) blocks.
  • Resource modeling was performed using GEMCOM Surpac software.
  • Whittle pit constraints assumed wall slopes of 26.5? for oxide and 45? for sulphide mineralization.
  • The base-case Mineral Resource Estimate assumes mining costs of US$1.54 / tonne, processing costs of US$3.91 / tonne (oxide-HL) and US$8.52 / tonne (sulphide-CIL) and G A costs of US$1.39 / tonne.
  • The base-case Mineral Resource Estimate assumes mining costs that are based on heap-leach processing for oxide material and carbon-in-leach processing for sulphide material. Metallurgical recoveries were based on preliminary testing by SGS Canada Inc. on Mankarga 5 samples as published on July 7, 2012, including 79% gold recovery in oxide (using 3/8? coarse-ore bucket leach test result as a proxy for heap leach processing) and 89% gold recovery in sulphide (the average of six bottle roll leach tests).
  • Specific gravity assumptions of 2.17 for oxide, 2.62 for sulphide and 2.70 for waste rock are based on measurements by the Company on 3,494 core samples from the Mankarga 5 deposit (approximately one sample for every 4.5 metres of core drilled).

Tanlouka Project Advancing Quickly

Channel?s activities at the Tanlouka gold project are focused on both advancing the Mankarga 5 deposit as quickly as possible through to feasibility and development, and demonstrating the additional exploration potential of the project. The Company has met several critical milestones for advancing Mankarga 5 including the estimate of mineral resources described in this release together with indications of favorable metallurgical characteristics of the deposit as published on July 7, 2012.

Upcoming news from the project includes:

  • Results from 2,000 metres of core drilling recently completed in the area of the Mankarga 1 target, to follow up on previous high-grade discovery holes drilled in 2010, and also to investigate possible mineralized continuity between Mankarga 5 and Mankarga 1; and,
  • Results from soil sampling programs underway on the Manesse and Tanwaka target areas to the north of the Mankarga Zone on the 79 square kilometre Tanlouka permit.

Future drill programs and other exploration activities are being planned for Mankarga 5 and other targets on the Tanlouka project based on the results of current programs and will be announced as news becomes available.

The independent mineral resource estimated by AMEC is consistent with the standards set out in Canadian Securities Administrators? National Instrument 43-101 and the Company is treating both the indicated and inferred gold resource estimate as a National Instrument 43-101 resource estimate. The Company anticipates that a report consistent with the form of a National Instrument 43-101 Technical Report, which will incorporate the gold resource estimate, will be filed on the SEDAR within 45 days. Mineral Resources which are not mineral reserves do not have demonstrated economic viability. Mineral resource estimates presented in this news release are by nature imprecise and depend, to a certain extent, upon geological interpretation and statistical inferences that are based on drilling information that may ultimately prove to be unrepresentative or unreliable. Military spending fight hits foreign oil, biofuel

ABOARD THE USS NIMITZ (AP) ? Some 100 nautical miles northeast of Oahu in the Pacific Ocean, a fleet of U.S. Navy fighter jets slings from the deck of the U.S.S. Nimitz aircraft carrier, leaving thin trails of smoke on the tight runway.

The operation, part of maneuvers involving several thousand sailors as part of the world's largest naval exercises in waters off Hawaii, was at the center of a growing controversy involving defense spending and foreign oil.

The dozens of air and sea vessels surrounding the Nimitz ? including helicopters, fighter jets and destroyer ships ? were running on a biofuel blend that can be substituted for traditional fuel without any engine modifications.

Navy officials say using the alternative fuel helps the military address weaknesses. Operations that use more than 50 million gallons of fuel each month rely on petroleum, making the U.S. military heavily dependent upon foreign oil.

Market volatility causes Navy spending to swing by tens of millions of dollars each time the price of a barrel goes up or down $1.

"We're not doing it to be faddish, we're not doing it to be green," Navy Secretary Ray Mabus said aboard the U.S.S. Nimitz on Wednesday. "We're not doing it for any other reason except it takes care of a military vulnerability that we have."

He added, "One of the things you better do as a military is take care of those vulnerabilities."

But the plan to use a 50-50 blend of alternative and petroleum-based fuel has hit a snag ? Congressional lawmakers who bristle at spending time and money chasing alternative energy at a time when defense spending is being cut and traditional oil is cheaper.

The House planned to vote Thursday on its version of the $608 billion defense spending bill, which cuts $70 million from the Obama administration's request for domestic development of biofuels production, while adding millions for submarines and Navy destroyers that the Pentagon didn't request.

The Senate Armed Services Committee last month narrowly passed an amendment to its version of the bill. The provision, pushed by Republican Sens. John McCain of Arizona and Jim Inhofe of Oklahoma, would prohibit military spending on alternative fuels if their costs exceed the cost of traditional fossil fuels.

At the time, McCain said buying biofuel at $26 per gallon ? the amount the Navy spent last year for 450,000 gallons of biofuels for this week's demonstration ? isn't in line with priorities of pursuing energy technology that reduces fuel demand and saves lives.

Inhofe went further, saying the Pentagon "should not be wasting time perpetrating President Obama's global warming fantasies or his ongoing war on affordable energy."

The Navy, along with the U.S. Departments of Energy and Agriculture, is spending more than $500 million in pursuit of biofuels and other alternative energy sources like solar and geothermal. The nearly $12 million purchase on the fuel for the demonstration came at a time when the Navy was spending just below $4 per gallon for traditional marine and jet fuel, according to Navy energy officials. The price has dipped dramatically since then, but is expected to rise to about $3.60 by the time the next fiscal year begins.

Mabus said the price of biofuels and other alternative sources will go down dramatically if the military makes massive purchases. Private industries, including the commercial airline industry, are interested and will join to help lower market prices, he said.

"I'm confident that as we get the story of what the Navy is doing completely out there, as we talk to members of Congress as we have been as we've been engaging them, that we will reach a common ground here in terms of making sure that America moves toward energy independence, making sure that America moves toward energy security," Mabus said.

Mabus said the Navy is still pressing ahead with its goal of getting half its fuel from alternative sources by 2020.

Two senators on the Armed Services Committee, Democrat Jeanne Shaheen of New Hampshire and Republican Susan Collins of Maine, have vowed to try to change the defense bill once it reaches the Senate floor, writing in a Politico column last week that the biofuels investments will result in long-term savings and are part of an "all-of-the-above" approach. Collins was absent during the committee vote, where the biofuels amendment passed 13-12.
