(AP) ? Connecticut's second-highest court on Monday ordered a new trial for a brain-damaged man serving life in prison for killing his former wife's grandmother, ruling that prosecutors suppressed evidence two decades ago that may have supported his alibi that he was home watching television.

Lawyers for Richard Lapointe, 66, argued that new DNA evidence proves he's innocent of the 1987 slaying and that his previous attorneys were ineffective.

The state Appellate Court ruled Monday that Lapointe didn't prove his innocence, but prosecutors had suppressed key evidence and his previous attorney failed to pursue the evidence issue.

Lapointe was convicted in 1992 of killing Bernice Martin, 88, who was found raped, stabbed and strangled in her burning Manchester apartment. Police obtained three signed confessions from Lapointe.

The court said it ordered a new trial because the state didn't disclose an expert opinion about the burn time of the fire in Martin's apartment that potentially supported Lapointe's alibi.

Judge Bethany Alford wrote in the 3-0 ruling that the state failing to disclose the information to the defense "affected the overall fairness of the trial and was so unfair as to undermine our confidence in the jury's verdict."

Lapointe's lawyers said experts concluded the fire couldn't have been started any earlier than 7:30 p.m. Lapointe's wife, meanwhile, told authorities that the only time her husband was not in her sight that night was between 6:15 p.m. and 7 p.m., when she gave their son a bath.

Lapointe's case was featured on national news shows and became a cause celebre as advocates for people with mental retardation and high-profile supporters such as writers Arthur Miller and William Styron rallied to prove his innocence. They said his mental disability made him vulnerable to being coerced into making confessions.

"It's a great day for justice," said Paul Casteleiro, a Hoboken, N.J., lawyer who represented Lapointe in the appeal. "It's taken 20 years for the court to recognize the injustice that was committed here. He's an innocent man in prison."

A prosecutor involved in the appeal didn't immediately return a message Monday seeing comment. The state may decide to appeal Monday's ruling to the Connecticut Supreme Court.

A previous appeal had been rejected by the state Supreme Court, and the U.S. Supreme Court declined to hear the case.

When Lapointe was a boy, he was diagnosed with Dandy-Walker Syndrome, a congenital condition where a cyst forms on the brain from a buildup of fluid on the skull.

Doctors operated five times, using a shunt to drain the liquid that left him with an enlarged head. But the condition wasn't caught in time. He suffered brain damage that left him with recurring headaches, dizziness and a short attention span. He was unable to finish high school.

Lapointe still led a seemingly normal life. He always had a job doing some sort of physical labor, such as dishwashing, and he even served as president of his condominium association. Prosecutors said his IQ was average.

He married Karen Martin, who had cerebral palsy, in 1977 and they had a healthy son, Sean. Martin's grandmother, Bernice, lived nearby.

Police and prosecutors said that Lapointe, while his wife got their son ready for bed on the night of March 8, 1987, walked to Bernice Martin's home. Authorities said Lapointe threw her on her bed and raped her, then stabbed her with a steak knife and strangled her after she threatened to tell Karen Martin.

Defense lawyers said Lapointe didn't kill Bernice Martin and only went over to her house to check on her at the request of a concerned relative, after the fire had been set. His lawyers said he watched TV while his wife put Sean to bed, and she found him in front of the television set when she came back downstairs about 45 minutes later. Karen Martin didn't notice anything unusual, defense lawyers said.

Bernice Martin's daughter, Natalie Howard, called Karen Martin, her niece, at about 8 p.m. that night, concerned that her mother wasn't answering the phone. Lapointe went over to check on Bernice Martin at Howard's request and called 911 when he saw smoke. He was there when firefighters and paramedics arrived.

Injuries due to child abuse on the rise

NEW YORK (Reuters Health) - More kids were hospitalized for serious injuries resulting from abuse in 2009 than in 1997, according to a new study - despite previous research suggesting fewer kids are maltreated now than in the past.

Researchers found the increase in serious injuries was due to more babies under a year old being hospitalized. The number of abused, injured kids and teenagers held relatively steady.

The findings are based on a survey of records from 2,500 or more U.S. hospitals conducted every three years.

"We're looking at the most seriously injured kids," said lead author Dr. John Leventhal, a pediatrician from the Yale School of Medicine in New Haven, Connecticut.

"The kids who get hospitalized for physical abuse represent a very small proportion of all the children in the country who are physically abused," he told Reuters Health - about two to four percent.

Leventhal and his co-author Julie Gaither consulted kids' hospital discharge forms for records of serious abuse, physical assault and shaken baby syndrome. They found the number of children hospitalized for those reasons increased slightly between 1997 and 2009, from 6.1 to 6.4 out of every 100,000.

Those children were kept in the hospital for a week, on average. Their most common injuries were fractures, open wounds and traumatic brain injuries.

Babies are known to be at the highest risk of physical abuse. Based on this sample, the number of infants under one year old with a serious abuse-related injury increased from 56.2 to 62.3 per 100,000 each year.

"Infants tend to be hospitalized at a much higher rate than older children, and I think it's because the injuries they sustain are much more serious," Leventhal said.

For example, he explained, slapping a six-year-old may leave a bruise, but slapping a baby could cause internal injuries.

And sleep-deprived parents are more likely to "lose it" with a baby who won't stop crying.

During the same time period, the number of babies, kids and teens hospitalized for serious injuries not related to abuse dropped by more than 20 percent, the researchers reported Monday in Pediatrics.

Leventhal said there are a few possible explanations for why serious injuries due to physical abuse may have increased while other studies have reported that abuse confirmed by Child Protective Services is on the decline.

It may be harder for CPS to substantiate abuse claims than in the past, he said. Or, most parents may be doing a better job of not hurting their children, but caregivers on the extreme end of the spectrum are still getting violent. Finally, it's possible that economic stressors could be causing more parents to lash out, according to Leventhal.

In another recent study, researchers found that kids' hospital admissions for physical abuse tended to increase as a local area's rate of delinquent mortgages and housing foreclosures rose (see Reuters Health story of July 17, 2012).

Dr. Joanne Wood, the lead author of that report from the Children's Hospital of Philadelphia, said the increase in hospitalizations in the new study is consistent with her own findings.

The results, she told Reuters Health, point to the importance of "doing a better job at the community level of identifying families who are under stress, who are under pressure, and helping to link them to resources that can help support them."

Leventhal said doctors need to work extra hard at catching the early signs of child abuse - as well as teaching parents how to deal with stressful moments without turning to violence.

His advice to parents at the end of their rope: "Step back, walk away, get help."

Patrick Murphy Leads Allen West By Nine Points: Dem Poll

WASHINGTON -- Rep. Allen West (R-Fla.) is trailing his Democratic challenger Patrick Murphy by nine points, according to a new Democratic poll.

The poll, conducted by Garin-Hart-Yang Research on Sept. 26-27, found that 52 percent of those surveyed support Murphy, compared to 43 percent for West, a Tea Party favorite. The margin widened even more among Independents: 58 percent said they backed Murphy versus 40 percent supporting the freshman Republican.

The poll surveyed 401 likely voters in Florida's 18th District and has a margin of error of 4.9 percent.

"It's clear that with his extreme, offensive rhetoric and record, Allen West is turning off voters all across the spectrum," said Alixandria Lapp, executive director of House Majority PAC, which released the poll on Monday. The PAC is currently airing its second TV ad against West as part of a $1.5 million TV buy in the district.

A West campaign spokesman did not immediately respond to a request for comment.

Monday's poll is the latest in a series of polls that show the preferences of the district's voters to be all over the map. Republican pollster Kimball Political Consulting showed Murphy leading West by 49 to 45 percent in a Sunday poll, while West's campaign released a poll last week that showed West ahead by nine points. Another poll released in August showed the candidates to be statistically tied.

The West-Murphy race is one of the most closely watched in the nation. West's campaign released a brutal ad last week targeting Murphy's 2003 arrest for disorderly intoxication and featured his mugshot from nine years ago next to a picture of West in a suit. Murphy's campaign hit back by highlighting that West was "kicked out of the military" that same year for assault.

UPDATE 11:41 a.m. -- West campaign spokesman Tim Edson said the "concocted poll" doesn't reflect reality.

"After a week where everyone, including liberal pundits, were writing Patrick Murphy's obituary, Murphy and his allies have to do something to make liberal contributors believe he is still viable," Edson said in a statement to The Huffington Post. "The fact that the DCCC cancelled advertising for Patrick Murphy validates the internal poll that we released last week showing Patrick Murphy down double digits."

Obama Blocks Wind Farm Sale To Chinese: Security Or Politics?

Whether there was a national security risk posed by a pair of big-time Chinese executives owning a cluster of tiny wind farms under development near a Navy weapons training facility in northeastern Oregon is difficult to say ? but it probably wasn?t hard for the man seeking reelection to see the political risks.

President Obama on Friday moved to swiftly dispense with a case that mixed China, renewable energy, trade and defense into a giant, complex ball of trouble; he ordered Ralls Corporation, owned by the chief financial officer and the vice president at the large but not state-owned Chinese manufacturing conglomerate Sany Group, to divest itself of the wind power projects.

This is the first time a president has used his power in such a fashion since President George Bush ? the first one ? stopped the sale of Mamco Manufacturing to a Chinese agency in 1990.

In an executive order, Obama said ?there is credible evidence? that led him to believe that Ralls ?might take action that threatens to impair the national security of the United States,? but he gave no specifics.

The president stepped in after the Committee on Foreign Investment in the United States (CFIUS) had raised red flags about the Ralls purchase, this past spring, of the projects, which consisted then of everything that comes before wind turbines actually go up at a site: land rights, permits, easements, interconnection agreements, a power purchase agreement (with PacificCorp), etc.

CFIUS is a panel headed by Treasury Secretary Timothy Geithner and consisting of the heads of a range of federal departments, Homeland Security, Energy, Justice, State, Treasury and Defense among them. By statute [PDF], the panel can review foreign acquisitions of U.S.-based businesses to ensure the transactions pose no threat to national security.

The Oregon wind farms ? four of them, each with five 2-megawatt turbines, adding up to 40 MW of generating capacity ? had been under development in Morrow and Umatilla counties near the Naval Weapons Systems Training Facility Boardman, and one of them was in the facility?s restricted airspace, called R-5701, on its east side.

This region of Oregon and Washington state around the Columbia River, a couple of hours or so east of Portland by car, is thick with wind farms. In fact, the massive 845-MW Shepherds Flat wind farm that went into full operation just a week ago borders the Boardman Navy test area on the west side, with some of its 334 turbines running right up to the edge of the restricted air space, if not into it.

The Navy has acknowledged it does?unmanned aerial systems operations?training at Boardman, and a Navy letter [PDF] to the Oregon Public Utility Commission mentioned that R-5701 is the ?only restricted area in the Western U.S. in which EA-6.8 Prowler and EA-18G Growler fighter jets based at Naval Air Station (NAS) Whidbey Island (Wash.) can complete Low Level Tactical Training and Surface-to-Air Counter Tactics maneuvers.? The Navy said such maneuvers are conducted ?to within 200 feet above ground level.? Turbines towers are often 80 to 100 meters tall, with the spinning blade tips reaching much higher than that.

Court and Oregon documents [PDF] indicate Ralls worked with the Navy to move the site of one of the wind farms 1.5 miles ? from the middle of the Navy?s restricted airspace to inside the southern edge. According to the Navy, until 2009 it had been able to count on the Federal Aviation Administration to keep wind farm developers out of its hair. However, ?(s)tarting in 2009,? the Navy said, ?the FAA determined the issuance of a Notice of Presumed Hazard for proposed construction within a restricted area was not appropriate and started issuing a Determination of No Hazard for proposed construction within R-5701.?

The Navy, with little leverage to force the wind farm completely out of its space, supported this move in a letter to Oregon regulators. Nonetheless, CFIUS ordered a halt to work on the projects, called High Plateau, Mule Hollow and Pine City, in addition to Lower Ridge, the one that Ralls had shifted to try to satisfy the Navy. (Together Ralls has referred to the wind farms as the Butter Creek projects, which aren?t to be confused with Butter Creek Power, a separate 4.95-megawatt Oregon wind farm that began operation in 2009.)

Two Americans killed in confused Afghan shootout

KABUL (Reuters) - Two Americans were killed in Afghanistan during an exchange of fire between NATO-led forces and the Afghan army that may have been the result of a misunderstanding, as the death toll of U.S. military and civilian personnel passed 2,000.

A U.S. official, who asked not to be identified, said on Sunday that an American soldier and a civilian contractor had been killed in the incident in eastern Afghanistan, the circumstances of which remain unclear.

The coalition initially said the incident may have been the result of an "insider attack" and another example of a member of the Afghan national security force turning on coalition troops in a war that began in 2001.

But it later said that nearby insurgent gunfire may have led to a misunderstanding.

"The circumstances were somewhat confused ... There was a report of insurgent firing taking place in this incident which we believe may have been a factor," Lt. General Adrian Bradshaw, deputy commander of the NATO-led coalition, said.

It was the latest setback for the coalition after the United States said joint operations with Afghan forces were returning to normal.

Joint operations were halted two weeks ago after a surge of attacks on the NATO-led International Security Assistance Force (ISAF) by its Afghan allies. At least 52 ISAF service members have been killed this year in so-called "green-on-blue" attacks.

The suspension of joint operations was a blow for NATO which wants to train the 350,000 members of the Afghan security forces so that they can try to ensure stability after coalition forces withdraw.

Pentagon data listing the number of U.S. troops and U.S. contractors killed in Afghanistan since combat began 11 years ago showed the two new deaths pushed the total combined number of U.S. personnel killed past the 2,000 mark.

The attack took place in the Sayed Abad district of the Wardak province, according to local police sources, who said a gun battle had broken out between coalition soldiers and Afghans when an Afghan National Army member opened fire on American troops.

Three members of the Afghan National Army were also killed in the firefight, while three other U.S. citizens and one Afghan were wounded, police spokesman Wali Mohammad said on Sunday.

"We appreciate the sacrifice of our fallen heroes, every death is tragic and important - none more than any other," ISAF said in a statement after the incident on Saturday.

Tension between coalition forces and their Afghan allies has been rising due to an escalation of so-called "insider" attacks, but Bradshaw denied the incident was a reflection of growing mistrust between Afghan and coalition forces.

"There is a very strong relationship between ISAF (the International Security Assistance Force) and our Afghan colleagues," Bradshaw told a press conference late on Sunday.

Separately on Saturday, police in eastern Kunar province said they had found the beheaded bodies of three male civilians in a forest.

The Taliban had kidnapped the men three days ago for allegedly spying for the government and NATO forces, Kunar police chief Shirwah Sameen told Reuters.

California bans gay "conversion" therapy for minors

SACRAMENTO (Reuters) - Governor Jerry Brown has signed a bill barring a controversial therapy that aims to reverse homosexuality in minors, the measure's sponsor said on Sunday, making California the first state to ban a practice many say is psychologically damaging.

The move marked a major victory for gay rights advocates who say so-called conversion therapy, also called reparative therapy, has no medical basis because homosexuality is not a disorder.

The bill's sponsor, state Senator Ted Lieu, a Democrat from Torrance, said in a statement that Brown had signed the bill. An announcement from the governor's office was expected on Sunday.

The bill prohibits children and teens under 18 from undergoing sexual orientation change efforts. It got support from the California Psychological Association and the California Board of Behavioral Sciences, among others.

"LGBT (lesbian, gay, bisexual and transgender) youth will now be protected from a practice that has not only been debunked as junk science, but has been proven to have drastically negative effects on their well-being," Human Rights Campaign President Chad Griffin said in a statement.

He urged other states to follow California's lead.

Lieu said the psychiatrist who pioneered the therapy, Dr. Robert Spitzer, has since renounced it and has apologized to the gay and lesbian community.

"If anyone had any doubts such practices were evil, they need only listen to accounts of victims who went through this abusive practice," Lieu said in a statement.

During the legislature's consideration of the bill, people who had undergone the therapy as minors testified about why they wanted the practice banned.

"As a young teen, the anti-gay practice of so-called conversion therapy destroyed my life and tore apart my family," witness Ryan Kendall told legislators.

Several openly gay legislators gave emotional speeches in support of the measure, sharing how they were bullied because of their sexual orientation as youths.

All major medical and mental health organizations including the American Medical Association and the American Psychiatric Association have denounced the practice, supporters said.

Opponents said the bill encroached on the rights of parents to make choices for their children. They also said politicians should not regulate what they considered to be a matter for medical boards to decide.

The measure will take effect on January 1.

Daily Kos: Jewish - nationality, religion or ethnicity?

I want to preface this before anyone gets all up in my face... This diary is meant as a real question.

Religion:
We all know that someone can practice the Jewish faith, Judaism. ?Going to synagogue, observing the holy days etc. ?So in that respect, it is a religion.

People of all ethnicity can become Jewish. ?They can accept the religion as their own and go through whatever rituals are required to then be considered person of Jewish faith.

This is indisputable.

Now comes the gray area, the one I don't quite understand and have conflicting information about.

Nationality and Ethnicity.

You see, in my family tree, just like Markos and our hate mailer George Rockwell, my family has Jewish "blood". ?We did a DNA test and there are indicators that our ancestors were Jewish.

Looking into our family tree we have found many instances of people who were Jewish. ?Most of them converted to Catholicism during the time of the Spanish Inquisition. ?Birth and Death certificates never tell the whole story so we do not know if they continued to practice in secret.

Some of them were from Russia and Spain/Portugal. ?Some from Germany. ?As most of you know, there were Jewish people scattered throughout Europe, practicing or not.
Jewish law requires that your mother be Jewish for you to be Jewish.

Our family also carries Tay-Sachs, which is prevalent among the Ashkenazi Jewish population.

So is Jewish an ethnicity, like Hispanic, Asian?
Is it a nationality?

There are anecdotal stories that some of our relatives may have practiced some of the Jewish holidays,

If you believe the bible, it would be surprising to find people who actually did not have ANY jewish genetics in them.
